How Does the H1B Visa Application Process Work?

Step 1 – Check Eligibility
Confirm you meet the educational, professional, and points requirements.

Step 2 – Apply for a Job in the U.S.
Look for vacancies with U.S.-based employers in your specialty area.

Step 3 – Employer Initiates the Petition
Your prospective employer must:

1. Obtain a Labor Condition Application (LCA) from the U.S. Department of Labor.

2. Guarantee fair wages and safe working conditions.

3. Disclose job location, company details, and the number of employees.

Step 4 – File a Petition With USCIS
The employer submits Form I-129 to the U.S. Citizenship and Immigration Services (USCIS) to request permission to hire you.
This form is also used for:

1. Extending employment

2. Hiring for multiple employers

3. Changing employers

Step 5 – Maintain Supporting Documents
The employer must provide:

1. Form I-129 with applicable fees

2. Anti-fraud fee and training fund fee

3. Company photos and details

Step 6 – USCIS Decision
If approved, USCIS issues Form I-797 (Approval Notice).

Step 7 – Employee Documentation

You must submit:

1. Valid passport (minimum 6 months)
